Terms & Conditions
These Terms & Conditions apply to work undertaken by Concours Classics and should be read alongside any quotation, estimate, Scope of Works, work authorisation, project variation or other project-specific documentation issued to the Client.
1. Contractual Documents & Acceptance
All project documentation issued by Concours Classics, including quotations, estimates, Scope of Works documents, work authorisations, project variations, progress reports and associated Terms & Conditions, may form part of the contractual agreement between Concours Classics and the Client.
By accepting a quotation or Scope of Works, providing written or electronic approval to proceed, paying a requested deposit, or instructing Concours Classics to commence or continue work, the Client confirms that they have read, understood and accepted the relevant project documentation and these Terms & Conditions.
Once accepted, the agreed Scope of Works, applicable quotation or estimate, approved variations and these Terms & Conditions together constitute the agreement between Concours Classics and the Client and are intended to be legally binding upon both parties.
Any subsequent changes, additions or variations to the agreed works that are authorised by the Client, including authorisation provided by email, text message or other written electronic communication, may also form part of the contractual agreement and may result in additional labour, materials, parts or third-party costs.
2. Project Progress Reports & Client Approval
With each invoice, the Client will receive a progress report outlining the work undertaken during the relevant billing period.
Where additional work, defects, corrosion, damage or other unforeseen requirements are identified during the course of the project, these will be communicated to the Client where appropriate.
The Client is requested to contact Concours Classics within 2 working days of receiving a progress report or invoice if they have any concerns regarding the work undertaken, the direction of the project, or if they wish to request any changes.
Where concerns or requested changes are raised, Concours Classics reserves the right to temporarily pause work while these matters are discussed and resolved.
Repeated changes, interruptions, alterations to the agreed Scope of Works, or delays in receiving Client decisions or approvals may affect the originally anticipated project timescale. Concours Classics cannot be held responsible for delays resulting from such interruptions or changes.
If no concerns are raised within 2 working days, Concours Classics will consider the work detailed within the progress report to have been accepted and the project will continue in accordance with the agreed Scope of Works and/or subsequent Client instructions.
Work completed during the relevant billing period remains chargeable and will be invoiced accordingly.
3. Workshop Consumables
General workshop consumables are charged at 10% of the labour cost shown on each invoice.
This charge contributes towards general consumable products used during workshop operations, including but not limited to grinding discs, cutting discs, sanding belts, DA discs, abrasive paper, masking products, filler and other general workshop consumables.
The workshop consumables charge is calculated against labour charges only and does not apply to separately charged materials, parts or outsourced services.
4. Materials, Parts & Paint
Materials are specific products, components or materials required to undertake work on an individual project and are charged separately to that project.
These may include, but are not limited to, sheet steel, steel tubing, repair panels, replacement components, fabrication materials, primers, paints, sealers, coatings and other project-specific products.
Paint and associated paint materials are included within the Materials section of the project and are charged as materials rather than being included within the general workshop consumables charge.
Where applicable, material, parts and paint costs will be itemised or otherwise identified on the relevant invoice/scope document/progress report.
Where prices for parts or materials are not known at the time an estimate or Scope of Works is prepared, their cost may be confirmed once the required items have been identified or sourced.
5. Outsourced & Third-Party Costs
Certain specialist services may be outsourced to trusted third-party suppliers or specialists where required as part of a project.
These services may include, but are not limited to, sandblasting or media blasting, powder coating, specialist machining, vehicle transportation, interior trim and upholstery, glass removal and installation, specialist testing and other externally supplied services.
Costs incurred specifically for the Client's project will be charged to the project and identified on the relevant invoice/scope document/progress report.
Where reasonably practicable, significant outsourced works will be discussed with the Client before being commissioned.
Outsourced services, or outsourced services which have already been agreed or which are reasonably necessary to undertake the agreed Scope of Works, may be commissioned without further individual approval.
6. Additional & Unforeseen Work
Classic, historic, modified and previously repaired vehicles can contain defects, corrosion, damage, poor previous repairs or other issues which may not be visible until components, paint, trim, underseal, filler or other materials have been removed.
Where additional or unforeseen work becomes apparent during the project, Concours Classics will communicate the findings to the Client where appropriate.
Any additional work authorised by the Client will be treated as a variation to the original Scope of Works and may result in additional labour, materials, parts and third-party costs.
Additional work may also affect any previously anticipated project completion date or timeframe.
If Concours Classics is required to amend minor repairs when adjacent works are being carried out this can be completed without notifying the client where reasonably appropriate. For example if Concours Classics are replacing a radiator and the adjacent hoses are split and will impede proper longevity of work carried out. The necessary repairs such as replacing inexpensive parts will be carried out with out notifying the client
7. Estimates, Costs & Project Timescales
Unless expressly identified as a fixed quotation, estimated labour hours, project costs and completion times are provided as estimates based upon the information and condition of the vehicle reasonably available to Concours Classics at the time.
Due to the nature of restoration, repair, fabrication, customisation and bespoke vehicle work, the full extent of the work required may not become apparent until the project has commenced or the vehicle has been dismantled.
Accordingly, estimates should not be interpreted as a guarantee of the final project cost or completion date unless expressly agreed otherwise in writing.
Concours Classics will endeavour to keep the Client reasonably informed where circumstances arise which are expected to materially affect the anticipated scope, cost or timeframe of the project.
8. Client-Requested Changes
Any request by the Client to alter, add to or remove work from an agreed Scope of Works may constitute a project variation.
Variations may affect labour requirements, materials, parts, third-party services, scheduling and the anticipated completion date.
Where Concours Classics has already incurred costs or undertaken work relating to an item subsequently cancelled or changed by the Client, those costs and completed work remain chargeable.
9. Public Statements, Reviews & Defamatory Content
Concours Classics respects the Client's right to provide honest feedback, express genuinely held opinions and raise legitimate concerns regarding the services provided.
Nothing within these Terms & Conditions is intended to prevent a Client from making a truthful statement, submitting an honest review, pursuing a genuine complaint or exercising any statutory or legal right.
The Client must not knowingly publish, communicate, distribute or encourage the publication of any statement or allegation concerning Concours Classics, its directors, employees, contractors or representatives which is false, deliberately misleading, malicious or defamatory.
This applies to statements made publicly or communicated to third parties, including but not limited to social media platforms, online review services, internet forums, websites, publications, businesses, clubs, organisations and other individuals.
Where the Client has a concern or dispute relating to work undertaken by Concours Classics, the Client is encouraged to raise the matter directly with Concours Classics at the earliest reasonable opportunity so that the circumstances can be investigated and an appropriate resolution sought.
Concours Classics reserves all legal rights and remedies available where false, malicious or defamatory statements cause, or are reasonably likely to cause, serious harm to the reputation of Concours Classics or associated individuals. This may include requesting the correction or removal of such material and, where appropriate, pursuing available legal remedies.
Nothing within this clause restricts the Client from making truthful statements, providing an honest opinion based upon their genuine experience, reporting a matter to a relevant authority, obtaining legal advice, or otherwise exercising rights which cannot lawfully be restricted by contract.
10. Communication & Written Instructions
The Client acknowledges that instructions, approvals and variations may be communicated electronically.
Where the Client provides approval or instructions by email, text message or other written electronic communication, Concours Classics may reasonably rely upon those instructions when progressing the project, ordering parts or materials, or commissioning third-party services.
The Client is responsible for notifying Concours Classics promptly if any instruction has been provided incorrectly or if they wish to amend or withdraw an instruction.
Where costs have already been incurred or work undertaken before an instruction is amended or withdrawn, those costs remain chargeable.
11. General
These Terms & Conditions are intended to operate alongside the individual Scope of Works/Estimate/Progress report/Invoice/Statement and other documentation relating to each Client project.
Where project-specific terms have been expressly agreed in writing, those terms will form part of the contractual agreement between Concours Classics and the Client.
Nothing within these Terms & Conditions is intended to exclude or restrict any statutory rights or legal protections which cannot lawfully be excluded or restricted.
By instructing Concours Classics to undertake work, accepting the relevant Scope of Works or quotation, paying a requested deposit, or otherwise authorising work to commence, the Client acknowledges their acceptance of these Terms & Conditions.
